How to make sure you maximize your workers’ comp benefits

On Behalf of | Jun 7, 2024 | Workers' Compensation

Workers’ compensation benefits are important for employees who suffer work-related injuries or illnesses.

Not everyone maximizes their benefits, though. This can mean not getting proper financial support during recovery. A few steps can help you make sure you maximize your benefits.

File the claim correctly

Incorrect or incomplete forms can delay or jeopardize benefits. Workers should ensure that they include all necessary information and submit the forms within the required timeframes.

Research benefits

The types of benefits available under Illinois workers’ compensation laws include medical benefits, temporary total disability benefits, permanent partial disability benefits and vocational rehabilitation.

  • Medical benefits cover all necessary medical treatments related to the work injury. They include doctor visits, hospital stays, surgeries, physical therapy and medications.
  • Temporary total disability (TTD) benefits occur if the injury prevents the worker from performing their job duties for a period of time. These benefits typically amount to two-thirds of the worker’s average weekly wage. TTD benefits continue until the worker can return to work or reaches maximum medical improvement (MMI), the point at which the condition is not expected to improve further.
  • Permanent partial disability (PPD) benefits are available if the worker sustains a permanent injury but can still work in some capacity. The amount of PPD benefits depends on the severity of the injury and its impact on the worker’s ability to perform their job.
  • Vocational rehabilitation benefits assist workers who are unable to return to their previous job due to their injury. These benefits may include job training, education and assistance with job placement.

Researching benefit rates can also help you plan financially.

Attend all required appointments

Workers may need to attend independent medical examinations (IMEs) or hearings related to their claim. Attending all scheduled appointments and hearings is necessary to avoid interruptions in benefits.

Keep detailed records

Workers should keep track of all medical visits, treatments and any communication with their employer or insurance company. Keeping copies of medical reports, bills and any correspondence related to the injury can help support the claim.

Follow medical orders

Following the doctor’s treatment plan is necessary for recovery and for maximizing workers’ compensation benefits. If the doctor prescribes rest, physical therapy or any other treatment, it is important to adhere to these recommendations. Non-compliance can result in reduced benefits.

By following these steps, workers in Illinois can ensure they receive the support needed during their recovery.
