Understanding workers’ compensation in Illinois

The workers’ compensation system in Illinois provides benefits to employees who suffer work-related injuries or illnesses. Understanding how the system works and the process can help you get better compensation. 

Filing a claim

To initiate a workers’ compensation claim in Illinois, you must notify your employer of the injury or illness. You must do it as soon as possible (ideally within 45 days of the incident). 

Once you’ve reported the injury, your employer should provide you with a claim form. It is the Employee’s Claim for Benefits (Form 45). You need to complete this form and submit it to your employer or their insurance carrier.

Medical treatment and benefits

After filing, you should receive medical treatment for your condition. Workers’ compensation in Illinois covers reasonable and necessary medical expenses related to the injury. Additionally, if you are unable to work, you may be entitled to temporary total disability (TTD) benefits. 

What if you get a denial?

If your claim is denied, you have the right to contest the decision. The first step is to file a Petition for Adjudication of Claim with the Illinois Workers’ Compensation Commission (IWCC). An arbitrator will review the case, and you may have a hearing to present evidence supporting your claim. 

Requesting more money

If you believe the benefits provided are insufficient, you can request a review or modification of the award by filing a Request for Review with the IWCC. You must provide evidence that supports your claim for increased benefits.
